Terms and Conditions of Service

By hiring the services of Mente Nueva Marketing, you accept the terms described in the contract provided to you before the project begins. These terms apply to all services offered: mobile app development, web design and development, social media management, online radio, TV streaming, graphic design and branding, artificial intelligence automations, and other related services.

Your continued use of our services implies acceptance of the terms. We reserve the right to update them periodically to reflect changes in our processes or legal requirements.

Each service is quoted individually based on the scope agreed with the client in the corresponding proposal or contract. The final scope, delivery times and specific deliverables are defined in writing before any project begins.

The prices published on our site are reference values ("from"). The final price depends on each case and is confirmed in each client's proposal and contract.

Payment terms vary by service: the Digital Evangelism Boost Plan and the Social Media plan for your business require a minimum 3-month contract; the landing page is paid 50% at the start and 50% at completion; the online radio + landing combo has an initial payment of $599 USD and then a monthly fee of $49.99 USD, with a minimum 12-month contract; and the mobile app has installment payments available.

Paid separately: the landing page domain and hosting ($180 USD per year); for the mobile app, from the second year, the annual maintenance fee and the Apple and Google accounts; and advertising spend (for example, on Meta), which the client pays directly to the platform.

Card payments are processed via Square and carry a 4% surcharge. Zelle payments have no fee.

The initial payment is non-refundable once work on the project has begun, since it covers the planning, design and development already carried out. The specific cancellation terms for each service are detailed in the individual contract signed with the client.

Once full payment for the project is completed, the client acquires the rights of use over the final deliverables (design, code, content) developed specifically for their project. Mente Nueva Marketing retains the right to display the work as part of its portfolio, unless otherwise agreed in writing.

The client agrees to provide the information, access and materials needed (texts, images, platform credentials) in a timely manner for the development of the project. Delays caused by a lack of this information may extend the agreed delivery times.

Mente Nueva Marketing does not guarantee specific business results (sales, attendance, followers) from the use of our services, since these depend on multiple factors beyond our control. Our commitment is to deliver professional, functional work in line with what was agreed.

These terms are governed by the laws of the State of California, United States, without prejudice to the local laws applicable in the countries where we operate (Colombia, Mexico, Puerto Rico, Spain, Switzerland and others).

Mente Nueva Marketing Corp ("Mente Nueva Marketing", "we") respects the privacy of its clients. This policy explains what information we collect, how we use it and how we protect it.

We do not share your mobile phone number. Your mobile number information and your consent to receive text messages are not sold, rented or shared with third parties or affiliates for marketing or promotional purposes. We only share it with the service providers we need in order to send the messages (for example, our messaging provider), and they may not use it for any other purpose.

We apply reasonable security measures to protect your information against unauthorized access, loss or misuse.

You can ask us at any time to update or delete your information, or to stop sending you messages, by writing to finanzas@mentenuevamarketing.com.

Mente Nueva Marketing Billing Notifications.

Clients with an active service contract receive messages about the billing and collection of that contract: due date reminders, pending payment notices with the payment link, payment confirmations and confirmations of calls scheduled with our sales team.

By signing the service contract and providing their mobile number, the client authorizes receiving these messages. Consent is not a condition of purchasing any service.

Message frequency varies depending on the status of each invoice.
